Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the Third Place mobile application and related services (the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Pre-launch status. Third Place is under development. Features, availability, and these Terms may change before public launch. We may suspend or limit access for testing, maintenance, or compliance.
1. Eligibility
You must meet the minimum age required in your jurisdiction to use a dating or social product (typically at least 18). You represent that you meet that requirement and have the legal capacity to enter into these Terms.
2. The Services
Third Place is designed to help users discover opportunities to connect with people in person, including through location-aware features tied to places you choose. The Services do not guarantee any particular outcome, match, or in-person interaction. We do not provide professional advice (legal, medical, or otherwise).
3. Your account
You are responsible for safeguarding your account credentials and for activity under your account. You agree to provide accurate information and to update it as needed. We may suspend or terminate accounts that violate these Terms or pose risk to others or to the Services.
4. Acceptable use
You agree not to:
- Harass, abuse, threaten, or harm other users;
- Post unlawful, fraudulent, or misleading content;
- Attempt to access accounts, systems, or data you are not authorized to use;
- Reverse engineer or interfere with the normal operation of the Services except as permitted by law;
- Use the Services for spam, scraping, or bulk collection of user data without our written consent;
- Misrepresent your identity, age, or intentions.
5. Content
You retain rights to content you submit, subject to a license you grant us to host, display, and process that content as needed to operate and improve the Services. You are responsible for content you upload and confirm you have the rights to share it.
6. Location and notifications
Some features may rely on device permissions such as location or notifications. You can revoke permissions through your device settings; certain features may not work without them. You are responsible for complying with local laws regarding recording, surveillance, or location sharing where applicable.
7. Third-party services
The Services may integrate with third-party providers (for example, authentication, maps, or cloud infrastructure). Those providers may have their own terms and privacy practices. We are not responsible for third-party services we do not control.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. IN-PERSON MEETINGS INVOLVE REAL-WORLD RISK; YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS AND FOR YOUR SAFETY.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIRD PLACE AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), UNLESS A DIFFERENT MINIMUM APPLIES UNDER MANDATORY LAW.
10. Indemnity
You agree to defend and indemnify Third Place against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms, except to the extent caused by our willful misconduct.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access with or without notice for conduct that we believe violates these Terms or harms the Services or other users. Provisions that by their nature should survive will survive termination.
12. Governing law
These Terms are governed by the laws of the jurisdiction where the operating entity is established, without regard to conflict-of-law rules, except where consumer protection laws require otherwise. You agree to the exclusive jurisdiction of the courts in that jurisdiction for disputes, where permitted by law.
13. Changes
We may modify these Terms. We will post updated Terms on this site and update the “Last updated” date. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional consent.
